Under Georgia Law, wrongful death claims are meant to allow victims to recover the monetary value of the full value of the decedent’s life. That value includes the decedent’s projected future earnings ― including payments such as pension, retirement, and Medicare ― without deducting personal expenses, such as living expenses. In the State of Georgia, a jury decides this value and no statutory formula is provided to assess the damages awarded.

Expenses incurred from the death can also be covered

The family or personal representative of the decedent is entitled to recover for medical and funeral expenses, and for other expenses resulting from the deceased person’s injury and death. Additional amounts may be received for the family’s pain and suffering, as well as for the loss of the decedent’s companionship.

It is important to note that in Georgia, the statute of limitations ― setting the time limit for filing a wrongful death claim ― mandates that a lawsuit for wrongful death will be barred if is brought more than two years following the decedent’s death.
